Permission to employ foreign labour

The second stage in the employing a foreign citizen for an above quota or quota position in Russia is the submission of documents to the Ministry of Internal Affairs for the permission to employ foreign labour. This permission gives the right to the Russian employer to hire foreign workers instead of Russian citizens. Attracting foreign labour without permission is illegal.

A permission to employ foreign labour has certain limitations. It indicates the maximum number of foreigners who are allowed to be employed. The permit also only applies to specific positions and countries of citizenship. It is possible to get a permission to employ foreign labour for a maximum of 1 year.

The procedure for obtaining a permission to employ foreign labour

At the first stage of employing a foreigner for an above quota position in the Employment Centre, you need to have a confirmation of the application. It is only possible to apply for a permission after your vacancy at the Employment Centre has been active for a month. If a month has passed and you submitted the documents to the Ministry of Internal Affairs, it is not recommended to close the vacancy.

The permissions are issued by the Ministry of Internal Affairs of Russia. It is necessary to apply to the regional bodies of the Ministry: in Moscow - to the Sakharov Migration Centre, and in the Moscow region - to the Greenwood Migration Centre.

Regardless of the number of foreign workers that you want to employ, you only need to get one permission.

To obtain a permission to employ foreigners, you need to pay a state duty in the amount of 10,000 rubles. Among other documents, a payment order certified by a bank should be submitted to the Ministry of Internal Affairs.

After receiving the documents, the Ministry of Internal Affairs submits a request to the Department of Labour and Employment, which then makes the decision. The Department can refuse for certain reasons and make the conclusion that using foreign labour in certain cases is unreasonable. In this case, the Ministry of Internal Affairs cannot issue a permit.

The deadline for registration of a permission is 1 month. Only after obtaining the permission can you apply for registration of a work permit. Unlike permissions to employ foreign labour, a work permit is issued individually for each person.

Documents for getting a permission to employ foreign labour

1. Request to the Department of Labour and Employment, 2 copies.
2. Confirmation of the submission of information about the need for employees in the Employment Centre.
3. Application for foreign labour, 2 copies.
4. Draft of the employment contract, signed only by the employer, 1 copy.
5. Power of Attorney, 2 copies.
6. Certificate of state registration, the original document and changes, 1 copy each. Notarized copies.
7. Certificate of tax registration and assignment of TIN, 1 copy Notarized copy.
8. Payment order with a blue stamp of the bank on payment of the state duty& for the issuance of permission to employ foreign labour in the amount of 10,000 rubles.
9. Charter of the company. A copy bound, numbered and stamped with the seal and signature of the head of the company.
10. Extract from the register, issued not earlier than one month before the submission of the documents, 1 copy.
